Terms of Use

These terms cover your use of the ScanCalorie app and website. Please read them before subscribing or relying on any of the nutrition estimates the app provides.

1. Acceptance of terms

By downloading, installing or using the ScanCalorie mobile application or visiting the scancalorie.fit website (together, the "Service"), you agree to these Terms of Use. If you do not agree, do not use the Service. These terms are an agreement between you and the team behind ScanCalorie ("we", "us", "our").

2. The Service

ScanCalorie is an iOS app that uses artificial intelligence to estimate calories and macronutrients from food photos and text descriptions, logs your meals and weight, and provides dashboards, streaks, meal plans and weekly reports. Features may change over time as we improve the Service.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of legal majority in your jurisdiction, you may only use the Service with the permission and supervision of a parent or legal guardian who agrees to these terms on your behalf.

4. Subscriptions and payments

ScanCalorie is free to download. Some features require a paid subscription. Current plans include a Weekly subscription at $4.99 and a Yearly subscription at $39.99. Prices in your local currency and the exact features included with each plan are displayed in the app before purchase and may change over time.

ScanCalorie is a general consumer wellness tool. It is not a medical device and does not provide medical, clinical, nutritional, diagnostic or treatment advice. Nutrition values shown in the app are estimates produced by AI and may not be precise.

Always consult a qualified healthcare professional before starting any diet, weight management program, or making changes to your nutrition — especially if you are pregnant, nursing, have a medical condition, take prescription medication or have a history of disordered eating. Do not rely on the Service for decisions that require professional advice.

7. Intellectual property

The Service, including the ScanCalorie name, app icon, designs, text, graphics and software, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable and revocable license to use the Service for your own non-commercial use in accordance with these terms.

You retain ownership of the content you submit — such as your food photos and meal entries — and grant us a limited license to process that content solely to provide and improve the Service.

8. Third-party services

The Service integrates with third-party services (including Apple and our AI and analytics providers). Your use of those services is subject to their own terms and privacy policies. We are not responsible for the availability or conduct of third-party services.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or that nutrition estimates will be accurate.

10. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid to access the Service in the twelve months before the claim or twenty US dollars.

11. Indemnification

You agree to defend and indemnify us against any claims, damages, liabilities and expenses arising out of your misuse of the Service or your violation of these terms, to the extent permitted by applicable law.

12. Apple-specific terms

These terms are between you and us, not Apple. Apple is not responsible for the Service or its content. To the extent these terms differ from Apple's standard End User License Agreement for App Store apps, the more restrictive terms (as to you) apply. Apple and Apple's subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Governing law

These terms are governed by the laws of the jurisdiction in which we operate, without regard to its conflict-of-laws rules. If you are a consumer, you may have additional rights under the mandatory laws of your country of residence, which these terms do not limit. Any disputes will be resolved in the courts of our operating jurisdiction unless applicable law requires otherwise.

14. Changes to these terms

We may update these terms from time to time. When we do, we will revise the "Last updated" date above. If changes are material, we will notify you in the app or on this page. Your continued use of the Service after the changes take effect means you accept the updated terms.
